IndonesiaVoice.com – Seruan tegas kembali disampaikan oleh Ephorus Huria Kristen Batak Protestan (HKBP), Pdt. Dr. Victor Tinambunan, agar pemerintah segera menutup operasional PT Toba Pulp Lestari Tbk (TPL), yang dinilai menjadi simbol kerusakan lingkungan, perampasan tanah adat, dan sumber konflik berkepanjangan di Tanah Batak.
1. Luas Konsesi dan Perampasan Tanah Adat
Berdiri dan memiliki konsesi lahan diatas tanah dan hutan adat Batak, TPL yang sejak tahun 1984 berdiri dengan nama awal PT Inti Indorayon Utama (IIU), TPL menguasai konsesi seluas 269.060 hektar berdasarkan SK Menteri Kehutanan No. 493/Kpts-II/1992.
Luasan ini mencakup wilayah adat dari sedikitnya 23 komunitas adat Batak, di seluruh Kawasan Danau Toba. Seluruh tanah di kawasan danau Toba adalah tanah adat dan selama ini menuntut pengembalian tanah ulayat mereka.
Data dari Aliansi Masyarakat Adat Nusantara (AMAN) menyebutkan bahwa sebagian besar wilayah konsesi TPL merupakan tanah adat yang tidak pernah dilepaskan oleh masyarakat, membuktikan perampasan tanah rakyat terjadi dimana-mana.
Hal ini memicu konflik lahan yang panjang dan belum terselesaikan membutuhkan kehadiran negara. Negara yang diam sama saja ikut serta sebagai pelaku.
2. Dampak Lingkungan yang Signifikan
Dalam tiga dekade terakhir, TPL tercatat telah melakukan penebangan jutaan meter kubik kayu alam untuk mendukung operasional pabrik pulp-nya di Porsea.
Kajian Wahana Lingkungan Hidup Indonesia (WALHI) menyebutkan bahwa deforestasi skala besar oleh TPL mengakibatkan:
– Kerusakan biodiversitas di Kawasan Danau Toba, yang merupakan ekosistem unik dan kawasan geowisata global.
– Hilangnya tanaman endemik seperti andaliman dan kemenyan, yang tidak hanya memiliki nilai budaya dan spiritual, tetapi juga berpotensi sebagai sumber obat-obatan alami.
– Pencemaran air dan udara akibat penggunaan bahan kimia dalam proses industri pulp, yang memicu berbagai keluhan warga sekitar, termasuk bau menyengat dan limbah beracun.
3. Konflik Sosial dan Kriminalisasi
Laporan dari Yayasan Pencinta Danau Toba (YPDT) dan berbagai media independen seperti Mongabay Indonesia menunjukkan bahwa konflik antara masyarakat adat dan TPL telah menimbulkan intimidasi, kekerasan, dan kriminalisasi.
Salah satu kasus paling mencolok adalah kriminalisasi petani adat di Natumingka dan Aek Napa, di mana warga yang mempertahankan tanah adatnya justru ditangkap aparat atas tuduhan perusakan dan penghalangan aktivitas perusahaan.
Kelompok perempuan adat juga mengalami pelecehan dan tekanan sosial yang mengancam martabat masyarakat Batak, terutama dalam konteks budaya yang menjunjung tinggi peran perempuan sebagai penjaga nilai adat.
4. Dugaan Manipulasi Pajak dan Tidak Adanya Dampak Ekonomi Langsung
Meski telah beroperasi selama lebih dari 30 tahun dan meraup keuntungan dari sumber daya alam Tanah Batak, kontribusi ekonomi TPL terhadap masyarakat lokal dinilai sangat minim.
YPDT menduga adanya rekayasa keuangan dan pembukuan kerugian semu untuk menghindari kewajiban pajak kepada negara.
Data dari Laporan Keuangan Publik TPL menunjukkan bahwa perusahaan pernah melaporkan kerugian bersih meskipun volume produksi dan ekspor pulp tetap stabil, menimbulkan pertanyaan mengenai akuntabilitas fiskal perusahaan ini.
5. Status PSN yang Kontroversial
Penetapan TPL sebagai bagian dari Proyek Strategis Nasional (PSN) oleh pemerintah menimbulkan kontroversi besar.
Menurut WALHI, status ini justru digunakan untuk melegitimasi penggusuran masyarakat adat dan memuluskan ekspansi perusahaan, tanpa ada evaluasi menyeluruh terhadap dampaknya terhadap lingkungan hidup dan hak-hak masyarakat adat.
6. Seruan dan Tuntutan
Kami dari Yayasan Pencinta Danau Toba (YPDT) menyatakan:
– Mendukung penuh seruan dari Ephorus HKBP Pdt Dr Victor Tinambunan sebagai suara profetik untuk menyelamatkan peradaban Batak dari kerusakan ekologis dan sosial.
– Mendesak pemerintah untuk melakukan audit independen dan menyeluruh terhadap operasional TPL, termasuk aspek lingkungan, sosial, fiskal, dan legalitas konsesi.
– Meminta penghentian segala bentuk kriminalisasi terhadap masyarakat adat dan pengakuan penuh atas hak-hak ulayat masyarakat Batak.
– Menyerukan solidaritas dari seluruh jemaat HKBP dan masyarakat Batak di seluruh dunia untuk bersama menuntut penutupan TPL demi masa depan generasi mendatang.
Penutup
YPDT mengajak seluruh masyarakat menjadikan Danau Toba menjadi “Tao Nauli, Aek Natio, Mual Hangoluan” dengan syarat dukung penutupan TPL sebagai sumber kerusakan danau toba.
Degradasi fisik danau toba telah terjadi penghancuran sekaligus juga menimbulkan kerusakan identitas, budaya, dan sistem kehidupan masyarakat adat.
Pemerintah tidak boleh abai terhadap penderitaan masyarakat Batak yang selama puluhan tahun menjadi korban ketimpangan struktural dan kesewenang-wenangan korporasi.
