916 Hektare Hutan Lindung di Konsesi Toba Pulp Lestari Digunduli

BETAHITA.ID – Dari ketinggian, melalui pantauan menggunakan pesawat tanpa awak (drone), hamparan lahan luas tampak gundul, hanya segelintir tegakan pohon yang tersisa di tengah-tengahnya. Sementara kendaraan alat berat jenis ekskavator terlihat beroperasi diiringi raung mesin chainsaw.

Berbatang-batang kayu eukaliptus yang sudah dipotong terlihat terkumpul, ditumpuk di beberapa titik. Terlihat pula sejumlah kendaraan truk yang tengah memuat tumpukan batang kayu eukaliptus itu.

Hengky Manalu, dari Aliansi Masyarakat Adat Nusantara (AMAN) Tano Batak, menyebut areal gundul yang berada di Kabupaten Humbang Hasundutan, Sumatera Utara, itu statusnya adalah hutan lindung. Areal tersebut masuk dalam konsesi Perizinan Berusaha Pemanfaatan Hutan (PBPH) Hutan Tanaman Industri (HTI) PT Toba Pulp Lestari (TPL), tepatnya di Sektor Tele.

“Itu statusnya hutan lindung. Memang dulunya hutan lindung ini ditanami eukaliptus oleh PT TPL. Sudah sepuluh tahun lebih tidak ditebang, tapi kemarin ditebang oleh PT TPL,” kata Hengky Manalu, dari Aliansi Masyarakat Adat Nusantara (AMAN) Tano Batak, 3 Agustus 2023 lalu.

“Pantauan lapangan menunjukkan aktivitas penebangan eukaliptus di lahan berstatus hutan lindung dalam konsesi PT Toba Pulp Lestari (TPL) di Humbang Hasundutan dan Samosir.”

Pada 5 November 2023, Betahita melakukan kunjungan dan pengamatan ke lokasi penebangan hutan lindung itu. Hasilnya, Betahita mendapatkan pemandangan seperti dipaparkan di awal.

Penebangan di hutan lindung tersebut tak hanya terjadi di wilayah Humbang Hasundutan saja, namun juga terjadi di wilayah Kabupaten Samosir. Di Desa Partungko Naginjang, Kecamatan Harian, penebangan eukaliptus di lahan berstatus hutan lindung bahkan lebih luas terjadi.

Berdasarkan penuturan warga setempat, bermarga Sinaga, penebangan eukaliptus di areal hutan lindung di desanya ini sudah terjadi sejak beberapa bulan. Pelakunya sama, yakni PT TPL.

Warga melihat penggundulan hutan lindung ini, sebagai kesempatan untuk melakukan reclaiming atau merebut kembali wilayah adat yang telah sejak lama dikuasai perusahaan. Saat ditemui Betahita, warga yang tergabung dalam sebuah komunitas adat tersebut bilang ratusan hektare lahan hutan lindung yang sudah digunduli PT TPL itu sebagian sudah direklaiming oleh masyarakat.

“Caranya kita tanami. Kita tanam apapun, bibit pohon buah atau tanaman pohon lain. Kita tidak mau lahan itu ditanami eukaliptus lagi oleh perusahaan,” kata warga bermarga Sinaga, 5 November 2023.

Direktur Kehutanan, Yayasan Auriga Nusantara, Supintri Supin mengatakan, pihaknya telah melakukan analisis spasial lewat metode remote sensing menggunakan Google Earth Engine, dan penerapan trajectories data pada tutupan eukaliptus milik PT TPL untuk mengamati pola dan siklus deforestasi, penanaman dan panen.

Hasilnya menunjukkan, sepanjang 2023, perseroan yang sering dihubungkan dengan taipan Sukanto Tanoto tersebut telah melakukan penebangan tanaman eukaliptus di dalam areal izinnya seluas 3.713 hektare. Dengan rincian 3.599 hektare di lahan berstatus kawasan hutan dan 115 hektare sisanya di lahan berstatus areal penggunaan lain (APL).

Dari luasan 3.599 hektare itu, kata Supin, 916 hektare di antaranya dilakukan di dalam kawasan hutan dengan fungsi atau hutan lindung (HL). Penebangan 916 hektare HL itu seluruhnya berada di Sektor Tele.

Analisis ini juga dilakukan di luar konsesi, radius 10 km dari batas areal izin TPL terbaru (SK KH SK 307 Tahun 2022). Supin menjelaskan, analisis di luar konsesi ini dilakukan karena dalam radius tersebut, citra satelit memperlihatkan adanya tutupan tanaman eukaliptus, berdasarkan time series pembukaan lahan untuk kebun kayu serta merupakan jarak terjauh eksisting eukaliptus dari batas izin PT TPL.

Hasilnya Auriga juga menemukan adanya kegiatan penebangan eukaliptus di luar konsesi PT TPL, seluas 692 hektare. Terdiri dari 59 hektare di APL dan 633 hektare di kawasan hutan.

“Dari 633 hektare di kawasan hutan itu, 9 hektare di HL. Menurut hasil pengamatan drone di lapangan November 2023 kemarin, memang kami mendapati adanya penebangan eukaliptus di HL yang sebelumnya pernah masuk dalam areal izin (sekarang sudah dikeluarkan dari izin) di Sektor Tele. Kalau dilihat dari analisis spasial, HL ini terhubung langsung dengan batas areal izin TPL,” kata Supin, Minggu (7/1/2024).

Masih berdasarkan hasil analisis, lanjut Supin, hingga Desember 2023, tutupan hutan alam di dalam konsesi PT TPL seluas 42.926 hektare. Tutupan hutan alam tersebut, 40.388 hektare di lahan kawasan hutan, dan 2.537 hektare di lahan APL.

“Analisis juga mengungkapkan adanya deforestasi atau penebangan hutan alam seluas 59 hektare di dalam konsesi PT TPL,” ungkap Supin.

Penebangan di hutan lindung salahi aturan

Soal penggundulan atau penebangan kayu di dalam kawasan hutan lindung, Supin menyebut aktivitas itu berpotensi menyalahi aturan. Berdasarkan Peraturan Pemerintah Pengganti Undang-Undang (Perpu) No. 2 Tahun 2022 tentang Cipta Kerja, hutan lindung adalah kawasan hutan yang mempunyai fungsi pokok sebagai perlindungan sistem penyangga kehidupan untuk mengatur tata air, mencegah banjir, mengendalikan erosi, mencegah intrusi air laut, dan memelihara kesuburan tanah.

Pemanfaatan hutan lindung, lanjut Supin, dapat berupa pemanfaatan kawasan, pemanfaatan jasa lingkungan, dan pemungutan hasil hutan bukan kayu. Lebih lanjut, pemanfaatan dan pengelolaan hutan lindung tidak boleh merusak lingkungan dan mengubah fungsi utamanya, karena itu terbatas dan mengutamakan pada pemanfaatan jasa lingkungan.

“Dalam Peraturan Pemerintah Nomor 23 Tahun 2021 tentang Penyelenggaraan Kehutanan, Pasal 149, menegaskan bahwa aktivitas perizinan berusaha pada kawasan hutan lindung dilarang melakukan penebangan pohon dan mengubah bentang alam,” ujar Supin.

Supin melanjutkan, atas dasar ketentuan tersebut maka aktivitas perusahaan ini jelas masuk kategori melanggar hukum, karena melakukan pemanfaatan hasil hutan kayu dalam hutan lindung. Supin mengatakan, saat melakukan kunjungan lapangan ke wilayah yang masuk dalam konsesi PT TPL, tepatnya di Sektor Tele, pada November 2023, terbukti pada areal hutan lindung dalam konsesi TPL dilakukan penebangan dan pengangkutan kayu.

“Pemerintah seharusnya tegas dan tak pandang bulu, pembiaran yang dilakukan pemerintah terhadap TPL menjadikan undang-undang seakan tak ada dan tak dihormati. Selain itu hal ini menjadi preseden buruk atas penegakan hukum di sektor kehutanan,” katanya.

Pada tahap lanjut, imbuh Supin, pembiaran dalam jangka panjang, memunculkan kecurigaan, dan penanggung jawab kehutanan di tingkat provinsi dan kabupaten harus dimintai pertanggungjawaban atas kerusakan dan kerugian lingkungan pada aset negara ini.

“Selain itu, pemungutan hasil hutan pada hutan lindung menimbulkan pertanyaan, apakah perusahaan membayar PNBP: PSDA dan DR? Karena pada hutan lindung tidak ada mekanisme perizinan hasil hutan kayu, jadi kalau PNBP kayunya diterima, siapa yang menerima? Apakah pendapatan itu masuk ke kas negara?” tanya Supin.

Supin mengatakan, suatu kawasan ditetapkan menjadi hutan lindung selalu karena memiliki fungsi tertentu, dan jika terjadi kerusakan akan berpotensi terjadi bencana. Fungsi pokok hutan lindung di antaranya untuk mengatur tata air, mencegah banjir, mengendalikan erosi, memelihara kesuburan tanah, dan bila kawasan tersebut di pesisir juga memiliki fungsi untuk menjaga intrusi air laut.

“Pada konsesi TPL, kawasan hutan lindung merupakan kawasan dengan topografi terjal dan merupakan daerah dengan tingkat curah hutan tinggi. Sehingga kerusakannya akan meningkatkan potensi bencana, seperti banjir, longsor, kekeringan dan lahan kritis,” katanya.

Tinjau ulang izin usaha di hutan lindung

Supin mengatakan, pemerintah perlu melakukan peninjauan terhadap laporan produksi kayu dan pembayaran Penerimaan Negara Bukan Pajak (PNBP) yang disampaikan oleh PT TPL. Sehingga dapat menentukan apakah kayu yang telah dipanen, dari hutan alam atau kebun kayu, telah dilaporkan dengan benar dan apakah royalti yang disyaratkan telah dibayar dengan penuh.

Kemudian, kata Supin, perlu dilakukannya evaluasi dan peninjauan ulang atas pemberian izin hutan tanaman industri di areal hutan lindung (HL) maupun areal penggunaan lain (APL). Serta menciutkan konsesi pada hutan lindung yang belum diekspansi menjadi hutan tanaman. Sedangkan pada kawasan hutan lindung yang telah dibangun kebun kayu untuk dipulihkan.

Supin juga berharap pemerintah membuka akses publik terhadap informasi izin dan perencanaan pembangunan hutan tanaman industri yang dilakukan oleh TPL, dan meninjau serta mengidentifikasi kawasan dengan Nilai Konservasi Tinggi (NKT).

“Serta mendesak TPL untuk melakukan perlindungan terhadap areal tersebut. Kita berharap pemerintah melakukan penegakan hukum atas kejahatan kehutanan yang ditemukan atas aktivitas pengelolaan hutan oleh TPL,” ucap Supin.

Hingga artikel ini selesai ditulis, tidak ada respon apapun dari pihak PT TPL atas upaya konfirmasi yang Betahita lakukan terhadap pihak perusahaan.     Vergleich zu Salbutamol beobachtet; Arrhythmien treten häufiger bei Patienten mit zugrunde liegender Herzerkrankung oder gleichzeitiger Anwendung von Theophyllin auf.
    Unerwünschte Wirkungen von Beta-2-Agonisten betreffen am häufigsten die Desensibilisierung des Beta-2-adrenergen Rezeptors
    gegenüber dem Beta-2-Agonisten.
    Unregelmäßige Herzschläge sind eine weitere beängstigende und potenziell gefährliche Nebenwirkung von Clenbuterol.
    Wenn es um Clen geht, sind diese Nebenwirkungen stark dosisabhängig.

    Ich bin eigentlich nicht der Typ, der seine Erfahrungen ins Netz stellt, aber in diesem
